Terms of use of BUSINESS.GOV.LV

These Terms of Use are binding for all users of the information system "State Platform for Business Development" (www.business.gov.lv).
Terms used
1.1. LIAA - Investment and Development Agency of Latvia (tax payer reg. 90001739473, legal address: 2 Pērses Street, Riga, LV-1442
1.2 Platform - information system "State Platform for Business Development" www.business.gov.lv;
1.3 Authentication - an electronic process in which an electronic identification service provider verifies the electronic identification data of a natural person in order to ensure electronic identification of that person;
1.4 E-Service - a form of service provision on the Platform that enables one or more services or individual stages thereof to be performed electronically;
1.5 User - a natural person who uses the Platform in accordance with these Terms;
1.6 Customer - a natural or legal person represented by a User registered on the Platform;
1.7. User Workplace - the workplace of the registered User on the Platform, where the User can switch between the Clients he/she represents and perform actions on the Platform in the Client's account that correspond to the User's level and which is available in the "Workplace" section of the Platform;
1.8 Client Account - Client's personalised information, started and completed activities on the Platform (e-services, events, cooperation offers, chat room entries);
1.9 Customer Profile - the section of the Customer Account completed by a registered user on behalf of the Customer. The Customer Profile may be published on the Platform.
2. General Information
2.1 The Platform is managed by LIAA.
2.2 All intellectual property rights in respect of the Platform are owned exclusively by LIAA. In the event of infringement of these rights, the guilty party shall be held liable to the liability prescribed by the laws and regulations and shall be fully liable for all damages caused or likely to be caused to LIAA and third parties.
2.3 The purpose of the Platform is to provide existing and prospective entrepreneurs with proactive and personalised information on sectors, export markets, cooperation offers, LIAA support opportunities, application for and receipt of e-services, participation in LIAA and cooperation partners' events, promoting business development in Latvia.
2.4 The platform is available on the website www.business.gov.lv and in the mobile app Business.gov.lv.
2.5 Before using the Platform, the User is obliged to get acquainted with the Terms of Use of the Platform and to comply with them. LIAA shall have the right to amend and supplement the terms of use of the Platform or issue new ones at any time, and such changes shall come into force from the moment they are published on the Platform.
2.6 If the User uses the Platform or performs any activities on the Platform, the User shall be deemed to have read and complied with the terms and conditions of use of the Platform in force at the time of use. The User is obliged to regularly review the Terms of Use of the Platform in order to be informed in due time of any changes thereto. If the User does not agree with the terms of use of the Platform, the User is prohibited from using the Platform.
2.7 For the purposes of the Platform, an electronic signature means the electronic data of the Users specified in Clauses 4.2 and 4.3 of these Rules, which ensures the authenticity of the electronic document and confirms the User's identity and that the electronic document or data input form on the Platform which has been signed by the User with an electronic signature shall be deemed to be signed by the User in his/her own handwriting.
3. Registration on the Platform
3.1 In order to become a registered User of the Platform, a person must comply with the registration procedure set out in the Platform.
3.2 A User may register on the Platform using the following means of authentication:
3.2.1. online forms verifying the identity of the person on the Unified Portal of State and Local Government Services (www.latvija.lv);
3.2.2. the Facebook authentication service;
3.2.3. the Google Authentication Service;
3.2.4. email and password.
3.3 The Client (legal entity governed by public law) shall be registered on the Platform by LIAA after concluding an agreement on the use of the Platform with the respective legal entity governed by public law.
3.4 In order for the Client (foreign legal entity) to apply for e-services and use other features of the role "administrator" referred to in sub-paragraph 4.3.2 of the Regulations, the Client shall submit to LIAA the company registration and representation authorisation documents to pasts@liaa.gov.lv or by post.
4. User rights:
4.1 Non-registered users of the Platform may access the information available on the public part of the Platform, i.e. all sections of the Platform except the "Workplace" section. Only Registered Users referred to in Clauses 4.2 and 4.3 of these Rules may apply for e-services, events, cooperation and real estate offers, start a new discussion in the chat room and comment in the chat room.
4.2 Registered users with Facebook, Google, email and password authentication have access to the information available in the public part of the Platform, as well as to the user workspace where the user can see personalised support options, add a new company, complete and submit an application for any e-services, cooperation and real estate offers, submit applications for e-services categorised in the user role.
4.3 Users registered with www.latvija.lv authentication can access the public part of the Platform and can add a Client (private legal entity) in the user's workspace and perform the following actions:
4.3.1. on behalf of the Client (natural person), view personalised support options, edit data in the Client's profile, complete and submit e-services, collaboration and real estate offers, start a new discussion in the chat room and make comments in the chat room and in the news;
4.3.2. on behalf of the Client (legal entity) in accordance with the Client's assigned representative role:
4.3.2.1. user with the role "user" - to view personalised support options, edit Client data in the profile, add a new Client, complete and submit an application for any e-service, submit a co-operation and real estate offer.
4.3.2.2 User with the role "Administrator" - view personalised support options, edit Client data in the Client profile and publish the Client profile in the public part of the Platform, complete and submit e-services, cooperation and real estate offers, start a new discussion in the chat room and make comments in the chat room and messages, invite other users to represent the Client by indicating the appropriate user role, remove rights granted to other users.
4.3.2.3. user with the role "contract contact person" - to view personalised support options, edit Customer's profile data, complete and submit an application for any e-service, submit e-service applications.
4.4 Registered User Responsibilities:
4.4.1. not to transfer or disclose the User's access data to another person;
4.4.2. to update his/her personal information in the Customer's account, including:
4.4.2.1. enter only true data;
4.4.2.2. update outdated data;
4.4.3. be responsible for all activities and information posted on the Platform, including all activities carried out by third parties, if such third parties access the Platform using access data that they have obtained with the User's permission or as a result of the User's negligence;
4.4.4. be responsible for the safe use of the Platform by ensuring that your device is protected during each session of use of the Platform, for example by a secure internet connection, anti-virus software, a firewall (a program that controls traffic between the client's computer and the computer network) and the latest software and operating system updates; in order to take full advantage of the features of the Platform, we recommend that you use the browser versions listed below or the most recently released versions of browsers:

4.4.5. notify LIAA of any problems using the Platform by sending a description of the problem to helpdesk@business.gov.lv or by calling 670 39 499;
4.4.6. not to take any action that would be detrimental to the security, stability and performance of the Platform;
4.4.7. not to take any offensive, abusive or unlawful action, and not to use obscene language;
4.4.8. when quoting or referring to information obtained from the Platform, indicate the source of the information at www.business.gov.lv.
5. Obligations and rights of LIAA:
5.1 LIAA has the following obligations:
5.1.1. to ensure the uninterrupted operation of the Platform and to inform the User about unplanned interruptions in the operation of the Platform by publishing information on the Platform and on the LIAA website;
5.1.2. provide the User with access to the terms of use of the Platform and the user manual (guide) of the Platform;
5.1.3. provide Users with access to the E-Services on the Platform;
5.1.4. inform the User about planned interruptions of the Platform by publishing information on the Platform;
5.1.5. within 2 (two) working days provide answers to questions submitted by Users regarding the use of the Platform, Platform error messages, availability of the Platform, etc.;
5.1.6. to comply with the personal data policy of the Users of the Platform when storing, correcting, deleting the Users' data from the Platform. All personal data of Users uploaded to the Platform shall be protected in accordance with the laws and regulations of the Republic of Latvia and processed in accordance with the Platform Privacy Policy.
5.2 LIAA shall have the following rights:
5.2.1. to change the procedure of provision of E-services of the Platform, to change the scope of E-services and information available to the User, the functional and visual solution of the Platform, without prior notice to the User;
5.2.2. to delete the Client's profile in the public part of the Platform "Companies", if the Client is liquidated;
5.2.3. to impose restrictions on the technological solutions with which the Service can be received in order to ensure the safe use and receipt of the Service;
5.2.4. to restrict, deny access or block the User's access rights temporarily or indefinitely, by informing the User if he/she does not comply with the terms of use of the Platform or has committed or attempted to commit illegal acts by using the facilities provided on the Platform.
5.2.5. deactivate temporary Users who have not completed their registration on the Platform within 10 (ten) days of the commencement of registration.
6: LIAA is not responsible for:
6.1. any inaccuracies or errors in the E-Service application submitted by the User, if they are not caused by the fault of LIAA;
6.2. any loss of any kind incurred or likely to be incurred by the Customer in connection with the use of the Platform and the content available therein, the User's access to the Platform, any technical problems in the operation of the Platform, changes to the Customer's profile data and activities in the Customer's account as a result of access by an unauthorised person, including any loss incurred by the Customer as a result of the use of the Platform on the User's behalf by an unauthorised person, whether intentionally or unintentionally;
6.3. unplanned interruptions in the operation of the Platform, if caused by communication failures or other technical reasons.
7. Dispute resolution
7.1 All disputes arising between LIAA and the User in connection with these Terms and Conditions shall be settled by mutual negotiation;
7.2. If disputes cannot be resolved by negotiation, they shall be settled in accordance with the laws and regulations of the Republic of Latvia.
8. Specifics of using the platform for legal entities
8.1. e-services on the Platform shall be used on behalf of a private legal entity by an authorised representative of the legal entity - a natural person who has registered as a Platform User.
8.2 If the official has the right of representation (signature) in the company registered in the Register of Enterprises and has been assigned a personal identification number in the Republic of Latvia - the official, when registering the User on the Platform and adding the company, is assigned the role of "administrator" by the Platform (see Clause 4.3.2 of the Regulations). If the representation rights of a legal entity are registered in the Register of Enterprises jointly with other persons, the Customer will be asked to submit a document of authorisation confirming the representation rights when applying for the service on the Platform.
8.3 The administrator of the Client (a legal entity governed by private law) may assign the following roles to the User as described in clause 4.3:
1) User,
2) contract contact person.
8.4 In other cases, in order to apply for and receive e-services on behalf of a legal entity, the legal entity must submit a written application to the LIAA specifying the officer or representative of the legal entity to be assigned the role of the Account Administrator of the legal entity (see sample application form here). The application shall be signed by the person having the right of representation. If the right of representation is determined jointly with other persons, the application shall be signed by all those persons.
8.5 The application, signed with a secure electronic signature, shall be sent to the following e-mail address: pasts@liaa.gov.lv. A handwritten signed application shall be sent to the following address: 2 Pērses Street, Riga, LV-1442.
8.6 LIAA shall examine the application and make a decision on granting the rights of Account Administrator of the legal entity to the person indicated in the application:
1) for applications sent electronically - within 3 (three) working days from its receipt;
2) for applications submitted by post or in person - within 10 (ten) working days of receipt.
8.7. The rights of the Account Administrator of a legal entity granted on the basis of the application of the legal entity shall be revoked by submitting a written application to the LIAA in the procedure set out above, except in cases when a person becomes an official in the company who has separate representation (signature) rights in the company registered with the Register of Companies (he/she is the only official in the company or is entitled to act separately).
