General provisions

  1. The Investment and Development Agency of Latvia (hereinafter - LIAA) is is a governmental administration institution under the authority of the Minister for Economics (www.em.gov.lv). In order to fulfil the tasks identified by the LIAA, the LIAA shall establish and maintain an information system "National Platform for Business Development BUSINESS.GOV.LV" (hereinafter referred to as "BUSINESS.GOV.LV"), which is available on the www.business.gov.lv web, as well as through the LIAA mobile application "BUSINESS.GOV.LV". The "BUSINESS.GOV.LV" mobile app is available on the Google Play Store and the Apple App Store.
  2. BUSINESS.GOV.LV shall ensure that data are processed in order to:
    • increase the export capacity of Latvian companies and promote external trade;
    • promote the involvement of foreign investment in the Latvian economy;
    • encourage business start-ups and development;
    • promote innovative business in Latvia, including by promoting cooperation between research and business sectors, as well as technology transfer and the commercialisation of technology rights;
    • implement measures under State aid programmes;
    • ensure the administration of activities co-financed by European Union funds and other foreign financial instruments;
    • implement the functions specified in the Tourism Law.
  3. The LIAA shall ensure the confidentiality of personal data processed within the "BUSINESS.GOV.LV" and shall implement appropriate technical and organisational measures for the protection of personal data from unauthorised access, unlawful processing or disclosure, accidental loss, alteration or destruction.
  4. The personal data processed within the "BUSINESS.GOV.LV", will be processed on the basis of (legal basis) (priority order):
    • entering into and executing an agreement of with LIAA or the persons represented by it, including the conclusion and execution of the contract to which the data subject is the contracting party;
    • performance of the duties of the LIAA specified in regulatory acts or resulting from statutory acts;
    • carrying out a task in the public interest;
    • the legitimate interests of the LIAA or the persons represented by it;
    • the consent of the data subject.
  5. Within "BUSINESS.GOV.LV", the LIAA shall process personal data on the following persons:
    • clients of the LIAA – natural persons;
    • clients of the LIAA – contact persons of legal persons;
    • counterparties, including subcontractors and natural persons associated with subcontractors;
    • recipients of information and personalised messages from LIAA;
    • visitors to events organised by the LIAA.
  6. Personal data for the "BUSINESS.GOV.LV" are collected both directly from the data subject and from external sources (i.e. state information systems) to reduce the need for the "BUSINESS.GOV.LV" user to enter data already registered in other state information systems.
    As a part of "BUSINESS.GOV.LV", the LIAA collects and processes the following categories of personal data for the client:
    • identification details: given name, surname and personal identity number (if authored via www.latvija.lv);
    • contact details - telephone number, e-mail address, declared and actual address;
    • "BUSINESS.GOV.LV" content preferences: the area of support of interest, sectors of interest and topics;
    • data on the services received by the "BUSINESS.GOV.LV" client within the "BUSINESS.GOV.LV";
    • business-specific data;
    • bank account details;
    • in order to maintain evidence of the user's actions for investigating potential disputes or claims, the log files shall keep the IP address and the date of the connection, the time;
    • if the user of the LIAA application "BUSINESS.GOV.LV" applies to participate in the event organised by the LIAA, the LIAA shall create and process (including, store) a personalised QR code for the participant of the event.

    Rights of the data subject

    • The data subject shall have the right to:
      • access their personal data and obtain the information provided for in Article 15 of the General Data Protection Regulation;
      • request the rectification of their personal data from the LIAA;
      • request the deletion of their personal data from the LIAA;
      • to request from the LIAA the limitation of the processing of personal data or the right to object to such processing pursuant to Articles 17 and 21 of the General Data Protection Regulation;
      • withdraw his/her consent to the processing of personal data at any time.
    • The data subject may submit a request for the exercise of his or her rights in written form to the LIAA Client Service Department by producing a personal identification document or by electronic mail, by signing with a secure digital signature and sending it to the pasts@liaa.gov.lv address. If the data subject has submitted a request for the exercise of his rights in written form in the form of electronic mail without signing with a secure digital signature, the LIAA will only provide information on the data received in the consignments from the e-mail address of the requested sender.
    • The data subject can access his or her personal data processed under "BUSINESS.GOV.LV" via the "BUSINESS.GOV.LV" application of the LIAA, as well as the https://www.business.gov.lv. website
    • The data subject may exercise the right to require the deletion or limitation of his or her personal data (including the right to object to processing pursuant to Article 17 and Article 21 of the General Data Protection Regulation) if the LIAA has no other legal basis and/or obligation to continue processing in accordance with the applicable laws.
    • The data subject has the right to submit complaints to a supervising body (Data State Inspection (www.dvi.gov.lv)) regarding the use of personal data, if the data subject considers that the rights and interests of such data have been infringed in accordance with the applicable regulatory enactments.
    • The LIAA undertakes to notify the data subject without delay of an infringement of the security of personal data, in the event that a breach of personal data protection could pose a high risk to the rights and freedoms of the data subject.

    Storage period

    • Personal data shall be processed for as long as necessary for the purpose of processing the personal data concerned. The storage period may be defined or based on a contract with the client, the legitimate interests of the LIAA or the applicable laws and regulations. After the legal basis for the storage of personal data expires, the personal data shall be deleted.

    Processing sites for personal data and their transfer to the processor

    • Personal data shall be processed at the premises of the LIAA (Perses iela 2, Riga, Latvia) and on information processing servers owned and/or provided for the use of the LIAA withinthe territory of the European Union or EEA.
    • Personal data may be transferred to the LIAA for processing:
      • For a person providing "BUSINESS.GOV.LV" functionality, data processing or IT services (information technology service providers, cloud-based software service providers, web page content hosting and management, data analysis, data backup, security and storage service providers (LIAA personal data is stored on servers located in secure data centres in the EU or EEA territory));
      • the person to whom the LIAA is required to provide information within the scope of the functions specified in regulatory enactments.
    • For the processing of personal data within the scope of the LIAA "BUSINESS.GOV.LV", one or more processors may be associated with the processing of personal data on behalf of the LIAA (hereinafter referred to as "the processor").
    • The LIAA shall conclude an agreement with each processor, which shall also include a condition regarding compliance with the rules for the use of "BUSINESS.GOV.LV" privacy policy and "BUSINESS.GOV.LV", as far as they are concerned, with the processing of personal data. The processor should also apply non-discriminatory technical and organisational measures to ensure the protection of personal data.
